Learning-Focused ("Learning-Focused," "we," "us," or "our") provides products, services, and professional learning resources through learningfocused.com and its Shopify-hosted online store and through Spark, our Thinkific-hosted professional learning platform. Spark includes courses, memberships, resources, and the Spark Apps, including SparkLEQ, SparkWriting, SparkEngagement, and other Spark-branded applications (collectively, the "Services").
This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit, use, purchase from, or otherwise interact with the Services.
If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, retention, and disclosure of personal information.
This is the company-wide Privacy Policy published on learningfocused.com and referenced by the policies for Spark at spark.learningfocused.com. It applies across the Services, although the information processed depends on which part of the Services you use.
By using the Services, you acknowledge that you have read and understand this Privacy Policy.
1) Who Our Services Are For
Our Services are designed primarily for adult K-12 educators, schools, districts, educational organizations, and customers purchasing Learning-Focused products or services. The website and store may be browsed by members of the public, but purchases, accounts, and Spark are intended for adults or authorized organizational users.
Spark Apps do not provide student accounts and are not directed to children under 13.
Spark Apps are designed to function without student names, student identifiers, education records, or other student personal information. Users and organizations must not submit or direct others to submit such information through Spark Apps.
2) The Platforms We Use
Our Services are delivered using third-party platforms:

Shopify hosts learningfocused.com and our online store and may process payments for store purchases.

Thinkific hosts Spark, including its courses, memberships, professional learning resources, and access to Spark Apps, and may process payments for Spark purchases.

Google Cloud Platform hosts the Spark Application programming interface (Spark API) and related application services.

OpenAI API processes relevant prompts and generates outputs for AI features in Spark Apps.

Analytics and measurement providers, including applicable Google services, help us understand website traffic, search performance, and service usage.
These providers may collect and process information about access to and use of the Services as necessary to provide, secure, maintain, analyze, and support their services to us, subject to their applicable agreements and legal obligations.

3) Personal Information We Collect
"Personal information" means information that identifies, relates to, describes, or can reasonably be linked to an individual or household. It does not include aggregated or de-identified information that cannot reasonably be linked to an individual.

Directly from you through website forms, newsletter sign-ups, account creation, shopping and checkout, purchases, Spark platform and Spark App use, support requests, reviews, surveys, event registrations, and other interactions

6) How Each Part of the Services Processes Information
A. learningfocused.com and the Shopify Online Store
When you browse learningfocused.com or use the online store, Shopify and related providers may process website activity, cookie and device information, account information, cart and checkout activity, order and payment information, shipping details, fraud-prevention signals, and customer-service information.
We use this information to operate the website and store, display and recommend relevant Learning-Focused products or content, maintain carts, process transactions, fulfill and support orders, prevent fraud, measure website performance, and communicate with customers.
Shopify and its payment partners process payment-card information. Learning-Focused receives transaction status and related order information but does not store full payment-card numbers.
Physical orders may require disclosure of a recipient's name, shipping address, telephone number, order contents, and delivery instructions to shipping, fulfillment, or delivery providers. Digital products may be delivered through Shopify, Thinkific, email, download links, or another service identified at purchase.
B. Spark Professional Learning Platform
Thinkific hosts Spark and may process account information, enrollments, memberships, course activity and progress, purchases, and communications needed to provide the platform. Learning-Focused uses this information to provide Spark access, administer memberships, courses, resources, and Spark App eligibility, support users, and understand participation in our professional learning resources.
C. Spark Apps Within Spark and AI Requests
How AI Requests Work
When you use an AI feature in a Spark App, your request is transmitted to the Spark API hosted on Google Cloud Platform. Relevant request content is then transmitted to OpenAI through the OpenAI API for AI processing. The generated output is returned through the Spark API to you.
Learning-Focused does not use Spark App inputs or outputs to train a generalized artificial intelligence model. OpenAI states that data submitted through its API is not used to train or improve OpenAI models unless the customer affirmatively opts in. Learning-Focused does not opt in to such training for Spark App data.
What Not to Submit
Do not submit:

Student names, student identifiers, education records, or other student personal information

Social Security numbers, medical information, or other sensitive personal information

Confidential information that you are not authorized to disclose

Content that you do not own or have the right to use
Responsibility for Outputs
AI-generated outputs may be inaccurate, incomplete, biased, or unsuitable for a particular context. You are responsible for reviewing and validating outputs before using them.
Spark Apps do not replace professional judgment and must not be used as the sole basis for decisions concerning student grades, discipline, eligibility, placement, special education, employment, teacher evaluation, or other decisions that could materially affect a person's rights, opportunities, or access to services.
7) Cookies, Analytics, and Measurement Tools
We and our service providers use cookies and similar technologies to:

Other cookies may support analytics, personalization, marketing measurement, or advertising where used and permitted. Cookie choices available to you may depend on your location, browser, and the tools presented on the website.
You can control cookies through your browser settings. Some features may not function properly if cookies are disabled.
If your browser sends a Global Privacy Control (GPC) signal, we will treat it as an opt-out request for sales, sharing, or targeted advertising where required by applicable law.

We may disclose information to comply with applicable law or valid legal process; investigate fraud, misuse, or security incidents; protect rights and safety; and enforce our agreements and policies.
C. In Business Transfers
We may disclose information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to applicable law.
D. With Your Direction or Consent
We may disclose information when you request, direct, authorize, or consent to the disclosure.
E. Sales, Sharing, and Targeted Advertising
We do not sell Spark App inputs or outputs, and we do not disclose Spark App inputs or outputs for cross-context behavioral or targeted advertising.
Certain website cookies or advertising and analytics technologies, if enabled, may be treated as a "sale," "sharing," or targeted advertising under some state privacy laws even when no money is exchanged. Where required, we provide a method to opt out, including by recognizing a valid Global Privacy Control signal as described above.
9) Children's Privacy and Student Data
Purchases, accounts, and Spark are intended for adults or school- or district-authorized adult users. Spark Apps do not provide student accounts and are not directed to children under 13. We do not knowingly collect personal information directly from children for independent use.
Spark Apps are designed to function without student names, student identifiers, education records, or other student personal information. Schools and districts must not direct users to submit such information.
If you believe student personal information or information from a child has been submitted inadvertently, contact us at support@learningfocused.com so that we can investigate and take appropriate deletion or other remedial steps.
10) Data Retention
We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, to provide and secure the Services, maintain accounts and user-requested content, comply with legal and accounting requirements, resolve disputes, and enforce agreements.

Account, membership, and enrollment records are generally retained while an account is active and for a limited period afterward as needed for administration, legal compliance, dispute resolution, and security.

Cart information is retained according to Shopify settings and applicable cookie or account functionality.

Order, transaction, shipping, return, customer-service, tax, and accounting records are retained for the periods needed to fulfill orders and comply with tax, accounting, warranty, dispute-resolution, and other applicable requirements.

Marketing subscription and suppression records may be retained as needed to honor communication choices and demonstrate compliance.

Spark App conversations, bookmarks, Workspace items, and other user-saved content are retained while the applicable feature or account remains active, unless the user or an authorized organization deletes them or requests deletion.

Operational, security, and diagnostic records are retained for limited periods appropriate to security, fraud prevention, troubleshooting, and service reliability.

Deletion from active systems may not immediately remove information from encrypted backups. Backup copies are isolated from ordinary use and are removed or overwritten according to the applicable backup lifecycle.
You or an authorized organization may request access, export, correction, or deletion as described below. We may retain limited information where required by law or necessary to document and protect our legal rights.
11) Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These safeguards include access restrictions and platform-provided encryption in transit and at rest, as applicable. However, no security measure is perfect, and we cannot guarantee absolute security.
Because the Services rely on third-party platforms, including Shopify, Thinkific, Google Cloud Platform, OpenAI, and analytics providers, security is a shared responsibility between Learning-Focused and those providers.
If Learning-Focused becomes aware of a confirmed security incident that materially affects user data, we will take reasonable steps to contain and investigate the incident and notify affected customers without undue delay, consistent with applicable law and applicable organizational agreements.

12) Your Rights and Choices
Depending on where you live, you may have rights to:

You may opt out of marketing emails at any time by using the unsubscribe link in the message. Even after opting out of marketing, we may continue to send transactional or service-related communications, such as order confirmations, shipping notices, account notices, and responses to your requests.
If your account is provided or managed by a school, district, employer, or other organization, we may refer the request to that organization or coordinate with it because the organization may control the applicable account or content.
We will not discriminate against you for exercising a privacy right provided by applicable law.
13) School and District Accounts
If a school, district, or other organization provides or manages your access, that organization may control account eligibility, assigned access, and organization-managed content and may submit requests concerning that content. Learning-Focused may provide the organization with administrative information needed to manage its subscription and authorized users.
Spark Apps are intended for adult educators and are designed to operate without student personal information. Unless Learning-Focused expressly agrees otherwise in a written agreement signed by an authorized representative, the Services are not intended to receive or maintain education records or other student personal information on behalf of a school or district.
Schools and districts may contact support@learningfocused.com to request privacy, security, subprocessor, retention, deletion, and data-flow information for legal or procurement review.
If an organizational agreement conflicts with this Privacy Policy, the organizational agreement controls for the organization and data within its scope to the extent stated in that agreement.
14) International Transfers
Your information may be transferred, stored, and processed outside your state, province, or country. Where required, we use recognized transfer mechanisms and safeguards.
15) Changes to This Policy
We may update this Privacy Policy as our Services, providers, or legal obligations change. We will post the updated policy and revise the "Last updated" date. Where required by law or an applicable organizational agreement, we will provide additional notice of material changes.
